These Terms and Conditions (“Terms”) govern all offers, sales, and services provided by Emblyx, a brand operated by DSC SOFTWARE SOLUTIONS SRL, a Romanian limited liability company registered under J2021002813160, VAT ID RO45171833, with its registered office in Craiova, Dolj, Romania.<\/p>\n

These Terms apply to and form a binding agreement between you (the “User” or “Customer”) and Emblyx Home regarding your access to and use of our:
\u2013 Online store and product purchase platform
<\/span>\u2013 Mobile applications and any third-party integrations we offer
<\/span>\u2013 Smart home products and connected devices (including but not limited to the Smart Intercom and EasyLift Bed)
<\/span>\u2013 Customer support, warranty, and optional service offerings (including integration and custom setup)<\/span><\/p>\n

These Terms apply to both consumers (as defined under EU Directive 2011\/83\/EU) and commercial clients, unless expressly stated otherwise.<\/p>\n

By accessing or using our website, placing an order, or registering an account, you confirm that you have read, understood, and agreed to be legally bound by these Terms and by our Privacy Policy, which forms an integral part of this agreement.<\/p>\n

We reserve the right to update or amend these Terms from time to time in accordance with applicable law. In such cases, the version in force at the time of your order or continued use shall apply. The presentation of products and services on our website does not constitute a legally binding offer, but rather a non-binding invitation for you to submit a purchase offer.<\/p>

By submitting an order through our website, you make a binding offer to enter into a purchase contract for the selected products and\/or services.<\/p>

A purchase contract is only concluded once one of the following occurs:

In accordance with Directive 2011\/83\/EU on Consumer Rights, if you are a consumer (i.e., a natural person acting for purposes outside your trade, business, craft, or profession), you have the right to withdraw from a purchase contract without providing any reason, within 14 calendar days from the date on which you, or a third party designated by you (other than the carrier), took physical possession of the goods.<\/p>

To exercise your right of withdrawal, you must initiate a return via the dedicated return request feature in your user account.
Requests submitted through other channels (such as email, phone, or social media) may be reviewed on a case-by-case basis but are not guaranteed to be accepted.<\/p>

If you withdraw from this contract, we will reimburse you without undue delay and no later than 14 days from the date we receive the returned goods, or from the date you provide proof of having returned them\u2014whichever occurs first.<\/p>

Refund Conditions:
\u2013 Only the purchase price of the goods will be refunded; initial delivery\/shipping costs are non-refundable
\u2013 The product must be returned in its original condition, including undamaged packaging, all accessories, manuals, and components
\u2013 We reserve the right to deduct from the refund an amount corresponding to any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods<\/p>

The return shipping costs are borne by the customer, unless the product is defective or delivered in error.<\/p>

Such minor discrepancies do not constitute defects and do not entitle the customer to any legal claims, provided they do not materially affect the product\u2019s intended use.<\/p>

We reserve the right to modify product features, technical details, or availability at any time without prior notice, where such changes are reasonable and do not adversely affect existing orders.<\/p>

All prices displayed on our website are shown in euros (EUR) and include Romanian value-added tax (VAT), where applicable, unless explicitly stated otherwise. Prices are based on EUR and may be converted and displayed in Romanian Lei (RON) using the exchange rate applicable on the respective day.<\/p>

We currently accept the following payment methods:
\u2013 Cash on delivery (available only for orders delivered within Romania)
\u2013 Visa and Mastercard credit or debit cards

Estimated delivery times and shipping fees are displayed during the checkout process. While we strive to meet stated delivery estimates, these are non-binding and may vary due to external factors such as customs clearance, carrier delays, or local service disruptions.<\/p>

Risk of loss or damage to the goods transfers as follows:
\u2013 For consumers (as defined under EU law): at the moment the goods are physically delivered to the customer or to a third party designated by the customer

The customer is responsible for providing accurate delivery information. Costs arising from failed deliveries due to incorrect or incomplete address details may be charged to the customer.<\/p>

All products must be installed, operated, and maintained in strict accordance with the instructions and safety guidelines provided in the accompanying installation manuals.<\/p>

For mechanical or electrically operated products, such as the EasyLift Bed, we strongly recommend installation by a qualified and certified technician. Failure to follow the prescribed installation procedures may result in product malfunction, reduced performance, or safety hazards.<\/p>

We expressly disclaim any liability for personal injury, property damage, or product malfunction resulting from:
\u2013 Improper or incomplete installation
\u2013 Unauthorized repairs or modifications
\u2013 Use contrary to the intended purpose of the product
\u2013 Failure to follow safety or maintenance instructions<\/p>

In order to maintain performance, security, and compatibility, we may provide software or firmware updates for our products either automatically or upon user initiation.<\/p>

By using our connected devices or associated applications, you acknowledge and consent to the receipt and installation of such updates, which may include enhancements, bug fixes, or critical security patches.<\/p>

Certain updates may be mandatory. Failure to install required updates may result in degraded functionality, interoperability issues, or security vulnerabilities. We accept no liability for any loss, malfunction, or exposure to risk resulting from the non-application of such updates.<\/p>

Warranty coverage is provided in accordance with applicable EU legislation and is limited as follows:
\u2013 For consumers (as defined by Directive 1999\/44\/EC and relevant national laws): 24 months from the date of delivery
\u2013 For business customers: 12 months from the date of delivery, unless otherwise agreed in writing<\/p>

Warranty claims must relate to material or manufacturing defects that existed at the time of delivery. The customer is responsible for reporting any defect within a reasonable period after discovery.<\/p>

We shall be liable only in the following circumstances:
\u2013 Intentional misconduct or gross negligence on our part
\u2013 Personal injury, death, or harm to health caused by a defect in one of our products
\u2013 Breach of essential contractual obligations (cardinal duties), but only to the extent that the damage was foreseeable and typical for the contract<\/p>

Except where otherwise required by mandatory legal provisions, we disclaim all liability for indirect or consequential damages, including but not limited to:

\u2013 For any use prohibited under applicable law, including military or dual-use applications without the necessary licenses<\/p>

The resale, commercial redistribution, or transfer of our devices to third parties for profit is strictly prohibited without our prior written approval or a valid, executed reseller agreement. Unauthorized commercial use may result in termination of warranty coverage, denial of technical support, and legal enforcement actions.<\/p>
